Terms of Use

 

These Terms of Use (hereinafter referred to as “these Terms”) establish the terms and conditions for using the services (hereinafter referred to as “the Service”) provided by administrator (hereinafter referred to as “Administrator”) on this website. Users of the service (hereinafter referred to as “User”) shall use the Service in accordance with these Terms.

 

 

Article 1 (Applicability) 

  1. These Terms shall apply to all relationships related to the use of the Service between the Users and Administrator.
  2. Administrator may establish various specific rules (hereinafter referred to as “Specific Provisions”), in addition to these Terms, and other regulations for the use of the Service. Regardless of their name, these Specific Provisions shall constitute a part of these Terms.
  3. In the event of any conflict between the provisions of these Terms and those of the Specific Provisions in the previous article, unless otherwise specified in the Specific Provisions, the provisions of the Specific Provisions shall take precedence.

 

Article 2 (User Registration) 

  1. In this Service, individuals desiring to register shall apply for usage registration by agreeing to these Terms and following the procedures set by Administrator. The completion of usage registration shall be deemed to occur when Administrator notifies the applicant of their approval.
  2. Administrator reserves the right to deny approval of a usage registration application if the applicant is deemed to have any of the reasons stated below. Administrator shall not be obligated to disclose the reasons for such decisions.
    1. If false information is provided during the registration application
    2. If the applicant has violated these Terms before
    3. If Administrator deems the registration application to be inappropriate for other reasons

 

Article 3 (Management of User IDs and Passwords) 

Users shall be responsible for appropriately managing their user IDs and passwords for the Service. Under no circumstances shall Users transfer, lend, or share their user IDs and passwords with third parties. If a user ID and password combination matches the registered information and is used to log in, it will be considered as being used by the User who registered that user ID. Except in cases where Administrator has intentional or gross negligence, Administrator shall not be liable for damages resulting from the use of a user ID and password by a third party.

  1. Users are responsible for appropriately managing their user ID and password for the Service.
  2. Under no circumstances shall Users transfer, lend, or share their user ID and password with third parties. If a combination of user ID and password matches the registered information and is used to log in, it will be considered as the use by the User who registered that user ID.
  3. Administrator shall not be held liable for any damages resulting from the use of a user ID and password by a third party, except in cases of intentional misconduct or gross negligence on the part of Administrator.

 

Article 4 (Usage Fees and Payment Methods) 

  1. Users shall pay the usage fees for the paid portions of the Service as determined separately by Administrator and displayed on the website, using the payment methods specified by Administrator.
  2. If a User delays payment of the usage fees, the User shall pay a late payment charge of 14.6% per annum.

 

Article 5 (Prohibited Activities) Users shall not engage in the following actions when using the Service:

  1. Acts that violate laws or public morals.
  2. Acts related to criminal activities.
  3. Acts that disrupt or interfere with the functions of the servers or networks of Administrator, the Service’s other users, or third parties.
  4. Acts that may hinder the operation of Administrator’s services.
  5. Acts of collecting or accumulating personal information of other users.
  6. Unauthorized access or attempts thereof.
  7. Impersonation of other users.
  8. Acts that directly or indirectly provide benefits to antisocial forces (organized crime groups, etc.) in relation to Administrator’s services.
  9. Acts that infringe upon the intellectual property rights, portrait rights, privacy, reputation, or any other rights or interests of Administrator, other users of the Service, or third parties.
  10. Posting or transmitting content on the Service that includes or may include expressions deemed inappropriate by Administrator, or as judged by Administrator.
    1. Content containing excessively violent expressions.
    2. Explicitly sexual expressions.
    3. Expressions that lead to discrimination based on race, nationality, creed, gender, social status, lineage, etc.
    4. Expressions that incite or promote suicide, self-harm, or drug abuse.
    5. Expressions containing antisocial content that may cause discomfort to others.
  11. Actions judged by Administrator to have the following objectives or purposes:
    1. Commercial, promotional, advertising, solicitation, or other profit-seeking activities (excluding those approved by Administrator).
    2. Activities with the purpose of engaging in sexual acts or indecent behavior.
    3. Activities with the purpose of meeting or engaging in relationships with strangers of the opposite sex.
    4. Activities with the purpose of harassing, defaming, or slandering other users.
    5. Activities with the purpose of causing harm, damage, or discomfort to Administrator, other users of the Service, or third parties.
    6. Activities diverging from the intended use of the Service, as defined by Administrator.
  12. Solicitation of religious activities or religious groups.
  13. Other actions deemed inappropriate by Administrator.

 

Article 6 (Suspension of Service Provision, etc.)

  1. In the event that any of the following circumstances are determined by Administrator, Administrator may suspend or interrupt the provision of all or part of the Service without prior notice to the User: 
    1. When performing maintenance or updates of the computer systems related to the Service 
    2. In case the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters 
    3. In case computers or communication lines are stopped due to accidents 
    4. In case Administrator determines that the provision of the Service is difficult for other reasons
  2. Administrator shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service.

 

Article 7 (Copyright)

  1. Users may use the Service to post or upload only information, such as text, images, and videos, for which they possess the necessary intellectual property rights or have obtained permission from the necessary rights holders.
  2. The copyright of text, images, videos, and other content posted or uploaded by users using the Service shall be retained by the user or other existing rights holders. However, Administrator may use such content posted or uploaded through the Service to the extent necessary for improving the Service, enhancing its quality, correcting deficiencies, promoting and advertising the Service, and the user agrees not to exercise moral rights in relation to this use.
  3. Except as provided in the preceding paragraph, all copyrights and other intellectual property rights related to the Service and all information associated with the Service belong to Administrator or the rights holders who have granted permission to Administrator for their use. Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making it possible to transmit), transmit, distribute, publish, or use for commercial purposes without permission.

Article 8 (Usage Restrictions and Registration Deletion)

  1. Administrator may, without prior notice, delete posted data, restrict all or part of a user’s use of the Service, or delete the user’s registration if the user falls under any of the following circumstances:
    1. Violation of any provision of this Agreement.
    2. False information is found in the registered information.
    3. The credit card provided by the user as a payment method has been suspended.
    4. Default in payment obligations, including fees.
    5. No response is received from the user within a certain period in response to communication from Administrator.
    6. No use of the Service for a certain period since the last use.
    7. Other circumstances where Administrator determines that the user’s use of the Service is inappropriate.
  2. If the user falls under any of the provisions of the preceding paragraph, the user shall lose any deadline-based benefits related to their obligations to Administrator and must immediately settle all obligations due at that time.
  3. Administrator shall not be liable for any damages incurred by the user as a result of actions taken by Administrator based on this Article.

Article 9 (Withdrawal) 

Users can withdraw from the Service by following the withdrawal procedures specified by Administrator.

 

Article 10 (Disclaimer and Limitation of Liability) 

  1. Administrator does not explicitly or implicitly guarantee the absence of defects (such as safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, etc., including errors, bugs, rights infringement, etc.) in the Service.
  2. Administrator shall not be liable for any damages incurred by the user due to the use of the Service, except for cases of intentional misconduct or gross negligence by Administrator. However, if the contract between Administrator and the user regarding the Service (including this Agreement) qualifies as a consumer contract under the Consumer Contract Act, this disclaimer shall not apply.
  3. Even in cases stipulated in the preceding paragraph, the Company shall not be held liable for any damages arising from special circumstances due to the Company’s negligence (excluding gross negligence) or any tortious act that causes damage to the user. This includes damages that the Company or the user could foresee or could have anticipated in relation to the occurrence of the damage. Furthermore, compensation for damages caused by the Company’s negligence (excluding gross negligence) resulting from failure to perform obligations or unlawful acts shall be limited to the amount of usage fees received from the user in the month when the damage occurred.
  4. Administrator shall not be held responsible for any transactions, communications, disputes, or any other matters that arise between users or between users and third parties in relation to the Service.

Article 11 (Changes to the Service) 

Administrator may change, add, or discontinue the content of the Service with prior notice to users, and users shall accept such changes.

 

Article 12 (Changes to the Terms of Use) 

  1. Administrator may change these Terms of Use without requiring individual consent from users in the following cases: 
    1. When the changes to these Terms of Use are in the general interest of users. 
    2. When the changes to these Terms of Use do not contradict the purpose of the Service usage agreement, and the changes are reasonable based on the necessity of the changes, appropriateness of the content after the changes, and other circumstances related to the changes. 
  2. Administrator shall provide users with prior notice regarding changes to these Terms of Use as specified in the preceding paragraph, including the intent to change these Terms of Use, the content of the revised Terms of Use, and the effective date of the changes.

Article 13 (Handling of Personal Information) 

Administrator shall appropriately handle the personal information acquired through the use of the Service in accordance with Administrator’s “Privacy Policy.”

 

Article 14 (Notifications or Communications) 

Notifications or communications between users and Administrator shall be conducted through methods prescribed by Administrator. Unless the user submits a change notification in accordance with the separate method specified by Administrator, the currently registered contact information shall be deemed valid, and notifications or communications to that contact shall be considered as reaching the user upon transmission.

 

Article 15 (Prohibition of Assignment of Rights and Obligations) 

Users shall not assign or pledge to a third party, without the prior written consent of Administrator, their contractual status or rights and obligations based on these Terms of Use.

 

Article 16 (Governing Law and Jurisdiction) 

In the event of a dispute regarding the Service, the exclusive jurisdiction shall be the court having jurisdiction over the location of Administrator’s main location.
